U.S. District Judge Ralph Erickson clarified September 4 the scope of his original ruling from August 27. The injunction applies in Alaska, Arizona, Arkansas. Colorado, Idaho, Missouri, Montana, Nebraska, Nevada, New Mexico, North Dakota, South Dakota and Wyoming. Legal counsel for the states, as well as NCBA and KLA, contended the injunction involves a federal rule and therefore should have applied nationwide. While the court injunction is temporary, NCBA and other agricultural and business groups have a pending lawsuit to challenge the rule in the 6th Circuit Court of Appeals. NCBA and KLA also continue to pursue a repeal of the rule through Congress. Earlier this year, the U.S. House passed bipartisan legislation calling for the rule to be withdrawn. A companion bill in the Senate has passed through committee and awaits further action. NCBA also is working with appropriations committees in Congress to defund enforcement by EPA. NCBA and KLA have argued the new EPA rule does not fall under jurisdiction granted by the Clean Water Act. The new rule subjects nearly all waters across the country to federal regulation, which was not the intent of Congress when it approved the Clean Water Act in 1972. For Kansas, the new rule means the federal government will expand its regulatory jurisdiction over stock ponds, most ditches and dry land located in the floodplain of intermittent and ephemeral streams. NCBA is aggressively working to nullify the Waters of the U.S. Rule.
